WHAT ARE THE COMMITMENTS OF SPEICHIM PROCESSING AND VALLS QUIMICA REGARDING THE PROTECTION OF PERSONAL DATA?

Séché Environnement is the controller of personal data collected via via the websites of its subsidiaries Speichim Processing and Valls Quimica https://speichim.com/ as well as on its institutional website https://www.groupe-seche.com/fr and its customer portal Séché Connect https://seche-connect.groupe-seche.com. As such, Séché Environnement undertakes to protect the personal data of its customers and prospects, as well as of candidates who submit a job application in the “careers” section of its website (collectively the “Services”).

Séché Environnement undertakes to comply with the regulations applicable to the personal data processing that it implements. In particular, Séché Environnement undertakes to ensure that:

  • Your personal data is processed in a lawful, fair and transparent manner (lawfulness, fairness, transparency).
  • Your personal data is collected for specific, explicit and legitimate purposes, and is not further processed in a way that is incompatible with these purposes (purpose limitation).
  • Your personal data is kept adequate, relevant and limited to what is necessary for the purposes for which it is processed (data minimization).

Séché Environnement, a public limited company with 1.571.546,40 EUR in share capital, registered at the commercial and business register of Laval, under the following registration number: 306 917 535, with headquarters at: Les Hêtres BP 20 – 53811 Changé, is the controller of your personal data throughout the use of the Services, in accordance with the French Law n°78-17 of 6 January 1978 (the “French Data Protection Act”) and with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “GDPR”).

  1. WHAT PERSONAL DATA DO WE PROCESS?

Personal data means any information that identifies you directly (for example, your name, first name, e-mail address and telephone number) or indirectly (for example, your account identifier, IP address or cookie identifier).

We only collect and use personal data that is necessary for our business.

The data we collect falls into three categories: (a) data that you provide to us, (b) data that we collect through automated means, and (c) data that we collect from other sources. We may combine the data you provide to us with data collected through automated means and from other sources.

About the personal data you provide to us

You may provide us with personal information when you:

  • fill out a contact form or a request for a personalized quote on our websites;
  • create a customer account and use the Séché Connect portal;
  • subscribe to our newsletters;
  • apply for a job, etc.

In this context, we are led to process the following personal data:

  • identification and contact information (surname, first name, company, job in the company, postal and e-mail address, landline and cell phone numbers, etc.) necessary to provide you with information about our products and services, answer your questions, provide you with quotes, send you communications about our news and activities, etc.
  • information necessary to qualify your needs, write reports of visits, etc. necessary to ensure the smooth running of our pre-contractual and contractual relationship;
  • CV, cover letter, professional experience, diplomas, training, current position, etc. when you apply for a job on our website.

Under no circumstances will we ask you for information relating to your racial or ethnic origins, your political opinions, your religion, your philosophical beliefs or your trade union membership.

About personal data we collect by automated means

We use automated technologies such as cookies to collect data from your computer or mobile device (phone or tablet) when you use our online Services.

We collect the following data to enable the proper functioning of our website, ensure the security of our networks, and perform audience measurement:

Some of the customer data we use may be collected from the following external sources, in order to verify or enrich our database:

  • data that you have made public on the website of the Ministry of Ecological Transition by declaring your waste on https://www.declarationpollution.developpement-durable.gouv.fr (e.g., name of the waste producer, types of waste, quantity);
  • data from the Sirene database of companies and their establishments, available on the website data.gouv.fr.

In addition, in order to respond to calls for tenders or to carry out commercial prospecting, we may have to process personal data of prospective customers (identification and contact information), which have been collected by our partners, in accordance with the applicable regulations on personal data.

  1. FOR WHAT PURPOSES AND ON WHAT LEGAL GROUNDS DO WE USE YOUR PERSONAL DATA?

A. TO PERFORM A CONTRACT WITH YOU OR PROVIDE YOU WITH PRE-CONTRACTUAL INFORMATION

  • fulfill your orders, process payments for our products and services, handle complaints, etc.;
  • provide our Services;

In order to accomplish the above-mentioned purposes, we disclose your personal data only to:

  • entities of the Séché Environnement Group that participate in the provision of Services;
  • service providers and subcontractors performing services on our behalf (for example, transporters, hosting, security and maintenance service providers for the Internet site, fraud management service providers, technical service providers in charge of sending e-mails and newsletters, etc.);
  • certain regulated professions such as auditors.

In addition, we may decide to sell or transfer some or all of our business. As part of such a sale or transfer, we may transfer the information we have collected and maintained (including personal data) to any person or entity involved in the transaction.

Finally, we may share your personal data with any authority, court or other third party where such disclosure is required by law, regulation or court order, or where such disclosure is necessary for the protection and defence of our rights.

  1. TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA

We do not transfer data outside the European Economic Area.

  1. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We will keep your personal data in an active database for the following periods:

  • for prospects: three (3) years after collection or your last contact with us (e.g., click on a hyperlink), unless you withdraw your consent before the three (3) year period expires.
  • for clients: until the end of our contractual relationship and, in any event, three (3) years from the date of your last contact with us;
  • for candidates who have applied for a job in the “careers” section of our website: for the duration of the selection process, and then, for unsuccessful candidates who consent, for two (2) years after your last contact with us, unless you request that your application file be destroyed before the two (2) year period expires;
  • for visitors to our website: up to twenty-five (25) months.

At the end of the periods mentioned above, some of your personal data will be archived, in an intermediate archive with restricted access, in compliance with our legal obligations and to defend our rights and interests in court, for the following periods:

  • ten (10) years from the end of the accounting period for data kept for accounting purposes, as well as for commercial documents (invoices, purchase orders, commercial correspondence, etc.);
  • in the event of pre-litigation, until the dispute is settled out of court or, failing that, as soon as the corresponding legal action becomes time-barred, it being specified that the common law limitation period in civil and commercial matters is five (5) years;
  • at the end of a dispute, until the ordinary and extraordinary remedies are no longer available against the decision rendered.

At the end of this additional period, your remaining personal data will be permanently deleted from our systems or anonymized.

In accordance with the applicable regulations, you have various rights, namely:

  • Right of access: you can obtain information about the processing of your personal data and a copy of these personal data.

  1. MISCELLANEOUS PROVISIONS

If a court or competent authority finds any provision of this policy to be invalid or unenforceable, that provision shall be deemed severed to the extent required. The validity and enforceability of the remaining provisions of this Policy shall not be affected thereby.

This Policy shall be governed by and construed in accordance with the laws of France. Any dispute arising out of this Policy shall be subject to the exclusive jurisdiction of the French courts.
